1. Acceptance of Terms

Welcome to Spaceshift: Ancient Chronicles ("the Game"), operated by MPEI ("we," "us," or "our"). By accessing, downloading, or playing the Game through our website, browser version, or mobile application (Android), you agree to be bound by these Terms of Service ("Terms").

If you do not agree to these Terms, you must not access or use the Game. We reserve the right to modify these Terms at any time, and continued use of the Game after changes constitutes acceptance of the updated Terms.

2. Eligibility and Account Registration

2.1 Age Requirements

The Game is available to users of all ages. However:

• If you are under 16 years old, you must have permission from a parent or legal guardian to use the Game.
• We comply with the EU General Data Protection Regulation (GDPR) and other applicable laws regarding children's privacy.
• Parents or guardians are responsible for monitoring and supervising minors' use of the Game.

2.2 Account Security

When you create an account or sign in using Google Play Services (Android), you are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately if you suspect unauthorized access
• Not sharing your account with others (account sharing is prohibited)

3. License to Use the Game

3.1 Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and play the Game for personal, non-commercial entertainment purposes.

3.2 Restrictions

You agree NOT to:

• Reverse engineer, decompile, or disassemble the Game or any part of its code
• Modify, hack, or create derivative works based on the Game
• Use cheats, exploits, automation software, bots, or hacks to gain unfair advantages
• Edit save files or manipulate game data stored locally or on servers
• Share, sell, or transfer your account to another person
• Use the Game for commercial purposes without our written permission (e.g., streaming for profit requires acknowledgment of our rights)
• Extract or redistribute game assets (graphics, music, text, characters) without authorization

Violation of these restrictions may result in immediate termination of your account.

4. Virtual Items and In-App Purchases

4.1 Future Purchases

Currently, the Game does not offer in-app purchases. However, we may introduce optional in-app purchases in future updates (cosmetic items, convenience features, etc.). If we do:

• Purchases are final and non-refundable except as required by applicable law
• Virtual items have no real-world value and cannot be exchanged for cash
• We reserve the right to modify, discontinue, or remove virtual items at any time
• You do not own virtual items; you receive a limited license to use them within the Game

4.2 Payment Processing

Any future payments will be processed through secure third-party payment providers (such as Google Play Store for Android purchases). Their terms and conditions will apply to payment transactions.

5. User Conduct and Prohibited Activities

While using the Game, you agree NOT to:

• Attempt to gain unauthorized access to our servers, accounts, or data
• Use any automated systems (bots, scripts) to interact with the Game
• Interfere with or disrupt the Game's servers or networks
• Attempt to circumvent any security measures or access control systems

5.2 Content and Communication

Note: The current version of the Game does not include chat or user-generated content features. However, if such features are added in the future, the following rules will apply:

• No harassment, threats, or abusive language toward other players
• No sharing of personal information (yours or others')
• No spam, advertising, or promotional content without permission
• No content that violates applicable laws or regulations

6. Intellectual Property Rights

6.1 Our Rights

All content in Spaceshift: Ancient Chronicles, including but not limited to graphics, artwork, music, sound effects, character designs, storylines, game mechanics, and software code, is owned by MPEI or our licensors and is protected by copyright, trademark, and other intellectual property laws.

6.2 Limited Use Rights

You may use Game content for the following purposes only:

• Taking screenshots or recordings for personal use or social media sharing
• Creating fan art or content (non-commercial) that clearly credits "Spaceshift: Ancient Chronicles by MPEI"
• Streaming or creating video content featuring gameplay (with proper attribution)

Any commercial use requires explicit written permission from MPEI.

6.3 User-Generated Content (Future Features)

If future updates allow user-generated content (custom station layouts, mission scenarios, etc.), you grant us a non-exclusive, royalty-free license to use, modify, and distribute your content within the Game and for promotional purposes.

7. Privacy and Data Collection

Your privacy is important to us. Please review our comprehensive Privacy Policy, which explains:

By using the Game, you also consent to the data practices described in our Privacy Policy.

8. Disclaimers and Limitation of Liability

8.1 "As Is" Disclaimer

The Game is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding:

• Game functionality, performance, or availability
• Compatibility with your devices or operating systems
• Freedom from bugs, errors, or interruptions
• Security of data transmission or storage

8.2 Limitation of Liability

To the maximum extent permitted by law, MPEI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, data, or business opportunities
• Device damage or malfunction
• Time spent playing or data lost due to technical issues
• Interruption of service or loss of saved game progress

8.3 Maximum Liability Cap

In no event shall our total liability to you for all damages exceed the amount you paid us in the twelve (12) months preceding the claim. Since the Game is currently free to play, this amount would be zero (€0) unless you make future in-app purchases.

9. Termination

9.1 Your Right to Terminate

You may stop using the Game at any time. If you wish to delete your account and data, please contact us using our Contact Form.

9.2 Our Right to Terminate

We may terminate or suspend your access to the Game immediately, without notice, if you:

• Violate any provision of these Terms
• Use cheats, hacks, or unauthorized modifications
• Engage in abusive or disruptive behavior (when applicable)
• Attempt to compromise the security or integrity of our services

9.3 Effect of Termination

Upon termination, your right to use the Game ceases immediately. We may delete your account data and game progress, though we will comply with applicable data retention laws and our Privacy Policy.

10. Governing Law and Dispute Resolution

10.1 Applicable Law

These Terms are governed by and construed in accordance with the laws of France. Any disputes shall be subject to the exclusive jurisdiction of the courts of Paris, France.

10.2 EU Consumer Rights

If you are a consumer residing in the European Union, you benefit from any mandatory provisions of consumer protection law in your country of residence. Nothing in these Terms affects those rights.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make changes:

• We will update the "Last Updated" date at the top of this page
• For material changes, we will provide notice through the Game or via email (if you have subscribed to our newsletter)
• Your continued use of the Game after changes constitutes acceptance of the new Terms
• If you disagree with changes, you should stop using the Game
